This paper reviews the formation of information law and the evolution of Personal Information Protection from the era of computer-based information processing in the 1970s to the advent of an AI-driven society. At each stage of technological innovation — the emergence of computers, the internet, social networking services and smartphones, and, finally, AI — it examines the legal challenges which arose and the concomitant transformation of the privacy landscape. The analysis surveys developments in domestic and international Personal Information Protection frameworks, including the enactment and subsequent amendments of the Act on the Protection of Personal Information (APPI), the OECD Privacy Guidelines, the EU GDPR and AI Act, the EU–Japan mutual adequacy findings, and APEC Cross-Border Privacy Rules (CBPR) system. Furthemore, illustrating issues likely to emerge as an AI society advances and next-generation technologies evolve, by tracing the historical interplay between technology and law, offers guidance on how legal systems should respond to the transformations brought about by emerging technologies.

Purpose: This study aims to fill the gap in the literature and to explore the potential of using cybernetic avatars as tools for climate and energy transformation within the context of public policies, demonstrating their role in heightening awareness and fostering positive attitudes towards sustainable energy among individuals, as well as enhancing the efficiency and communication of public administration. Design/methodology/approach: In the context of disseminating knowledge about the climate impacts of day-to-day human activities, the authors address main elements that constitute the specific basic terms of reference for a draft framework aimed at using cybernetic avatars as tools for climate and energy transformation. Findings: The symbiosis of consumer awareness, technological innovation, and educational endeavours, facilitated by cybernetic avatars, constitutes the linchpin for an environmentally responsible and sustainable energy future. As the energy sector adapts to the evolving preferences of the new generation, the integration of avatars and advanced technologies emerges as a pivotal factor in sculpting a conscientious and ecologically sustainable energy landscape. Social implications: Energy 4.0 technologies transform the energy sector. Industry 4.0 drives digitalisation, which brings various means, such as Internet of Things, artificial intelligence, blockchain and the metaverse, that reshape energy markets and enable distributed energy transactions. These technologies combine to create the concept of avatarisation, which imagines a digital representation in a virtual world, driving us towards Society 5.0. Originality/value: The authors propose a draft framework for the implementation cybernetic avatars in climate and energy policy (“Nexus Avatar Platform for Sustainable Future”), consisting of three main elements: vision, tool scope, and policy coherence.

In order to identify international trends in AI governance , this paper overviewed the status of AI-related legislation in 74 countries and institutions and analysed the current status of main trends in relation to the Organisation for Economic Co-operation and Development, (OECD), the G7 Summit, the United Nations, the AI Safety Summit, and Brazil, Canada, China, the EU, Peru, the UK, and the US, which have started to develop legislation for AI governance.
Through this research, international trends in AI regulation legislation have been surveyed and analysed to contribute to policy-making which will support the future of AI governance.

This article aims to illustrate the basis for the development of authentication, which will be the foundation of future cybernetic-avatar (CA) infrastructures, enabling the safe and secure use of CA’s. This will be realised by the authentication of CA operators (User Authentication Technology), identification and authentication of CA’s (CA Authentication), and ensuring connectivity and existence between operators (User Entities) and the CA’s themselves (CA Notarisation). An ELSI (Ethical, Legal, Social Implications) research platform will be established, to develop a new dimension of the legal field, that is, AI, Robot, and Avatar Law to solve the social issues and realise an avatar lifestyle.

Effect of Robot Notification on Acquiring Permission to Use Personal Information

With recent technological developments, such as machine learning, data collection has become increasingly important. However, due to privacy issues, there is an ethical problem in collecting data on everyday activities. In this study, we aimed to develop a mechanism for acquiring consent interactively by using a robot and, as a first step, focus on a dialogue strategy in which users feel safe to provide their data. Specifically, we investigated the effects of reminder and rationale provided by the robot in situations where consent is obtained. We conducted two experiments in which users conversed with a virtual robot agent in a crowd setting. We found that the robot reminder improved the degree of understanding regarding the use of data. In addition, the permission rate was improved by robot notifications. However, no effect of rationale was observed. These results contribute to the discussion on the ethical aspects of data collection by robots.

This paper (i) proposes the "rules (regulations)" necessary for the research and development, use, sale and supply of AI systems and services, (ii) respects voluntary efforts to comply with them, (iii) establishes "rules (harmonised standards, technical standards and requirements)" to act as "de facto mandatory standards" in the sale and supply of services, (iv) establishes management system standards to plan, implement, check and act on them, (v) establishes a legal basis for disciplining these mechanisms, and (vi) establishes the 'AI Supervisory Commission (tentative name)', (vii) which will unveil the concept of AI regulation with the 'Japanese AI System Conformity Assessment System'.
On the other hand, instead of continuing the trial-and-error approach of considering soft law, which is expected to be exclusively self-disciplining and may not need to be observed, the aim is to overcome the resistance to hard law associated with the introduction of regulations (such as legal prohibitions on substantive issues), against which there are persistent objections, and to address the issues of principles and guidelines that have been discussed so far. To achieve this goal, this paper attempts to move away from the theory of law and regulation avoidance, which leaves compliance to voluntary initiatives and does not regulate through hard law, to 'optimise' AI regulation in the light of international trends, and to propose new measures that will contribute to future AI regulatory policy in the research, development and use of AI.

Pandemics and the Protection of Privacy and Personal Information: Issues concerning the Restriction on the Right to Privacy in Emergencies

This article focuses on issues which need to be considered in aiming to ensure both the effectiveness of infectious disease control measures and the protection of the right to privacy from the following perspectives.
　(1) Issues regarding the restriction of the right to privacy in emergency situations, including (i) the types of measures taken in emergency situations and issues with respect to the restriction of the right to privacy in emergency situations, (ii) the normalisation, constancy and fixation of exceptional measures in emergency situations, (iii) dual-use and use for purposes different from those originally intended, (iv) acquisition of secondary information and the emergence of unexpected situations (e.g. the applicability of "body temperature" to special care-required personal information and the acquisition of secondary information associated with the measurement of body temperature, and examples of mission creep); and (5) the need to respond to over-reaction without recognising the urgency of the situation.
　(2) Issues concerning privacy in countermeasures against infectious diseases, including (i) the procedures for requesting and disclosing personal information and privacy, (ii) the obligation to cooperate in active epidemiological investigations of specific patients and others based on the amended Infectious Diseases Control Act and restrictions on the right to privacy, (iii) the applicability of personal information concerning the acceptance of tests and other examinations as special care-required personal information, and (iv) the need to respond to over-reaction without recognising the urgency of the situation. (ii) the necessity of the implementation of information security management measures in relation to infectious disease countermeasures.
　(3) Issues concerning the use of technology for the purpose of countermeasures against infectious diseases and privacy, including (i) the use of GPS location information, (ii) considerations required to resolve concerns in the introduction and spread of contact confirmation applications, (iii) the acquisition of biometric information and the use of biometrics, and (iv) sewage epidemiological surveys and privacy (privacy of drainage).

Smart cities do not exist without robotics and Artificial Intelligence (AI). During the COVID-19 pandemic, they can assist in combating the novelcoronavirus and its effects, and preventing its spread. However, their deployment necessitate the most secure, safe, and efficient use. Thepurpose of this article is to address the regulatory framework for AI and robotics in the context of developing resilient organisations in smart citiesduring the COVID-19 pandemic. The study provides regulatory insights necessary to re-examine the strategic management of technology creation,dissemination, and application in smart cities, in order to address the issues regarding the strategic management of innovation policies nationally,regionally, and worldwide. To meet these goals, the article analyses government materials, such as strategies, policies, legislation, reports, andliterature. It also juxtaposes materials and case studies, with the help of expert knowledge. The authors emphasise the imminent need forcoordinated strategies to regulate AI and robots designed for improving digital and smart public health services globally.

We are currently promoting a project to develop (physical or virtual) avatar technology and to create a society where everyone can engage in various activities as they wish, beyond physical constraints, by using avatars. We are particularly concerned with enriching our communications, interactions, and relationships through avatars. However, this aim cannot be achieved by technology alone. We have to consider the ELSI (ethical, legal and social issues) concerning avatars as well. In this workshop, the speakers will introduce some of our technologies and then raise ethical and legal questions concerning avatars. Then we would like to discuss these issues with all the participants.

Purpose

India is a fast-growing economy, that has a majority share in the global information technology industry (IT). Rapid urbanisation and modernisation in India have strained its energy sector, which is being reformed to cope. Despite being the global IT heart and having above average research output in the field of artificial intelligence (AI), India has not yet managed to leverage its benefits to the full. This study aims to address the role of AI and information management (IM) in India’s energy transition to highlight the challenges and barriers to its development and use in the energy sector.
Design/methodology/approach

The study, through analysis of proposed strategies, current policies, available literature and reports, discusses the role of AI and IM in the energy transition in India, highlighting the current situation and challenges.
Findings

The results show dispersed research and development incentives for IT in the Indian energy sector; however, the needed holistic top-down approach is lacking, calling for due attention in this matter. Adaptive and swift actions from policymakers towards AI and IM are warranted in India.
Practical implications

The ongoing transition of the Indian energy sector with the integration of smart technologies would result in increased access to big data. Extracting the maximum benefits from this would require a comprehensive AI and IM policy.
Social implications

The revolution in AI and robotics must be carried out in line with sustainable development goals, to support climate action and to consider privacy issues – both areas in India must be strengthened.
Originality/value

The paper offers an original discussion on certain applicable solutions regarding the energy transition of AI coming from the Global South; they are based on lessons learned from the Indian case studies presented in this study.

「サイバネティック・アバター（CA）」の研究開発、利用、社会実装及びに受容性に係る法的課題について、従来からのELSI課題の抽出や分析にとどまらず、「サイバー」と「フィジカル」の双方の問題が融合する「サイバー・フィジカル・システム（CPS）」の研究開発及び利用に伴う法的課題の展開も踏まえたCAに係る法律論を「アバター法」と称し検討に着手。CAの法的位置づけ（存在証明）を検討するための新説を展開し、有体物CAと無体物CAに分けた定義を試み、CAを社会で利用するにあたって、その展開・実装のあり方についての今後の検討に向けた試論として、「本人」による「本体」の利用形態を考案した。当該「本体」の利用形態については、①顕名CAと②匿名CAに分けて検討を行う試論を展開し、CAの研究開発においては、顕名CAと連結可能匿名CAの利用に向けた検討を研究開発の段階から行っておくことが有用であるとの提案を示した。連結不可能匿名CAの研究開発の危険性を指摘するとともに、当該危険性を排除するため本人と本体CAとの連結可能性を担保する仕組みとして、適合性評価や第三者認証の仕組みが必要であるとの見解も示した。

The following perspectives will be deliberated with regard to fundamental considerations for ensuring both the effectiveness of infectious disease control measures and the guarantee of the right to privacy:
　(1) issues concerning the restriction of the right to privacy in emergency situations, including: (i) measures associated with emergency situations and the restriction of the right to privacy in a such situations; (ii) normalisation, regularisation and the continuing of exceptional responses in emergency situations, (eg concerns about 'roll-back' and the 'ratchet effect'); (iii) use for purposes different from those originally intended, ('Dual-Use'); and (iv) acquisition of subsidiary information and unexpected emergence of unexpected situations, (eg the applicability of 'human-body temperature' to personal information requiring consideration and subsidiary information associated with the measurement of human-body temperature and the example of 'mission creep'); and (ⅴ) the need to respond to over-reactions which do not recognise the urgency of the situation.
　(2) Issues concerning privacy in infectious disease control include: (i) procedures for requesting and disclosing personal information and the issues related to privacy; (ii) the obligation to cooperate with active epidemiological surveys of specified patients and others based on the revised Infectious Diseases Control Act and restrictions on the right to privacy; (iii) the correspondence between the personal information taken and thus, sensitive personal information acquired in relation to the taking of tests, etc, (iv) the implementation of tests for infectious diseases which are not included in the tests to be taken and the violation of privacy and (ⅴ)the necessity of thorough security management measures for information management in relation to countermeasures against infectious diseases.

We need to have a response to the COVID-19 Coronavirus infection which will lead to effective countermeasures against any future pandemics caused by infectious and deadly diseases. These diseases could have a serious impact on the lives and health of people worldwide, therefore, this paper will examine, from the point of view of the handling of personal information and the protection of the right to privacy, methods by which we may create these effective countermeasures against any unknown infectious diseases.
We will begin our discussion by determining exactly what a pandemic is, based on the definition by CDC and WHO. A part of this determining will lead us inevitably to a review the Japanese legal system for dealing with pandemics and not only taking into account such pandemics which have been caused by naturally occurring infectious diseases, but also those which have been the result of attacks using biological weapons or bio-hazardous terrorism.
　Having a comprehensive pandemic legal system response will require the collection, utilisation and publication of infectious disease-related information based on the Infectious Disease Law. We will also need to clarify the structure and issues of the current system/mechanism regarding information acquisition and the management of infected people.
　Thus, this paper will scrutinise the handling procedures for personal information acquired in the course of implementing infectious disease countermeasures, the issues related to the applicable laws and regulations, the collecting and utilisation of sensitive information related to disease. The procedures regarding the use and provision of personal data. Finally, I will attempt to propose a new theory from the point of view formulating new judgment criteria regarding the limits of interpretation of exemptions based on the improvement of public health and the need .

Emerging technologies such as AI and autonomous robots and the consideration to increasetheir industrial use are rapidly progressing. Furthermore, research anddevelopment of lethalautonomous weapon systems（LAWS）are also advancing. As part of an international debate,regulations in the framework of the Convention on the Restriction of the Use of Certain ConventionalWeapons（CCW）have been discussed and basic principles have been proposed. In this article, theinternational humanitarian law applicable to LAWS, the report of the United Nations DisarmamentInstitute（UNIDIR), the status of discussions from the level of informal LAWS experts meetings to theGovernment Expert Meeting（GGE）on the LAWS lethal autonomous weapon system, the contents ofproposed guiding principles, and the status of consideration regarding legal and ethical aspects forregulating LAWS are described and confirmed.

「AI原則ブーム」が到来するとの予想のもとで、AI原則を単なる非拘束的な原則として活用を求める段階から、AIの実用・実装に対応した法規範においてその活用を考えるべきではないかという提案を試みることが本稿の目的である。
第三次AIブームの興隆によって、社会の様々な場面でAIの研究開発からその活用が現実化するとともに、その適正な利用のために原則策定の重要性が認識されるようになりつつある。そのため、エマージング・テクノロジー（新興技術）の活用を見据えて必要な対応を推進するための取り組みとして、基本法的なものを整備することで非拘束的な「原則」と謳ってきたものを基本原則として定めたり、法定公表事項として当該原則を組み込んだルール作りを考えることはできないだろうか。
新たな問題に対応するためのルール作りは、EUにおける取り組みが様々な局面で先行しているが、「AI規制」に向けた検討においても同じ図式が繰り返されようとしている。本稿では、国内外における原則・ガイドライン等策定の現況を概観するとともに、EUにおける検討動向について、「信頼できるAIのための倫理ガイドライン」の内容と「評価リスト」に至るまでの動向から、AI規制の方向性を示すホワイト・ペーパーの内容を概観することで、今後の規制に向けた方向性を把握する。これは我が国における今後の取り組みを考えるうえで、EUの取り組みを参考にすることは重要であるとの認識に基づくものである。
　最後に、OECDが「人口知能に関する理事会勧告」を採択した意義とともに、法的拘束力を有さない原則が法整備において参照されているOECDプライバシー・ガイドラインの位置づけを再確認することで、非拘束的なガイドラインではあるものの、OECDプライバシー８原則が各国の法制度において参照されるに至っている点に着目し、非拘束的原則が普遍的原則として用いられてきたことを敷衍する。

In the future, autonomous robots equipped with artificial intelligence (AI) will become more widespread in our society. These emerging technologies are driving the consideration of not only improvements in the development of their industrial use, but also further research into the ethical and legal issues. For example, robot acquisition of data in the form of 'life-logs' may lead to data confidentiality issues which we are not able to solve by focusing solely on AI data acquisition issues. A life-log is a comprehensive archive of personal, everyday life which is collected by computing technologies. This information is sometimes used for business purposes, such as online behavioural advertising. However, the meaning of the term life-log is vague. Similarly, the distinction between Personally Identifiable Information (PII) and Non-Personally Identifiable Information (non-PII) is not clear. In this paper, I detail and explain the current and complete range of legal accountability issues related to the collection of data for constructing a life-log. I propose a method for managing legal responsibility when life-logs are created and then used by others, whether they are individuals or organisations. Finally, I indicate the need to both clarify and streamline any future regulations related to life-logs.

A huge amount of information is handled and processed in our daily lives and being generated thus creates a tremendous amount of digital data at present. Such a burgeoning volume of data which is created as a by-product of human activities is called 'Big Data'. With the advances made by the handling of such Big Data, some novel problems have occurred. The issues regarding Cloud Computing and Behavioural Targeting Marketing are typical examples of improvement in these areas being discussed as an emergent problem of handling personal information. However, the definition of the term 'Big Data' is still vague and uncertain. In this paper, I will discuss the suitability or rights and wrongs of the use of the term 'Big Data' as a catch phrase for discussing the latest problems. Finally, I will examine the recent issues regarding the handling of such information.

This paper will focus on the definition of the term 'life-log' and will suggest a proposition for managing the

I will try to clarify the complete range of legal accountability issues related to the collection of data for
constructing a 'life-log'. I will examine the following issues:- concerns about the technical and legal issues of
using 'lifelogs'; obligations related to the Personal Information Protection Act; principles concluded by (2010
May) the Study Committee of the Ministry of Internal Affairs and Communications of Japan; Self-Regulatory
Principles for Online Behavioural Advertising by the Federal Trade Commission and industry groups in the
United States. I will make reference to some legally important cases concerning the public disclosure of embarrassing and 'private facts' of a specific individual and of such publicity placing this individual in a false
light in the public eye. Finally, I will examine the legal accountabilities of handling 'lifelogs'.

The Guidelines were the first internationally agreed statement of the core information privacy principles and remain an important point of reference in contemporary policy discussions. The Guidelines have had a substantial impact, including as a basis for national laws. Nearly every OECD country now has one or more laws protecting privacy, up from one-third of OECD countries when the Guidelines were agreed. The Guidelines have also served as a basis for other international instruments, like the EU Directive 95/46/EC and the APEC Privacy Framework (2004). More broadly, the Guidelines have served as a basis for policies and self-regulation, influencing business practices and shaping the expectations of individuals.

The Right of Publicity provides to each and every person the right to use one's persona, name, image, and likeness for one's benefit and provides a cause of action to stop the unauthorized use of that persona for commercial purposes. The Emergence of the Right of Publicity is an outgrowth of the right to privacy recognized by the courts, however, the ossification of publicity rights as property has stained traditional notions of property dispositions in settings such as a real right. In this report, I will examine the legal characteristic of the publicity right from the point of both the property rights and the personal rights by verifying a general view of the judicial precedent and the legal theories.

However the purpose of the enactment of Five Law concerning the protection of personal information which shall come into force on the 1st of April 2005 is not for the protection of the right to privacy and also the leakage of personal data will not be directly punished for violation of these law it has just prescribed the duties to be observed by companies handling personal information. This paper presents the necessity for clear distinction between the problem of the privacy protection in libraries and protection of personal information.Then considers the influence on libraries and library services by clarification of the application of a law contents of the dutiesand exclusion from application of the Law.

政府及び民間の事業者が用いている監視手段の問題を総合的に検討した。特に、公的部門（政府）による監視手段の利用をめぐる問題については、その正当化の根拠となる安全保障、犯罪予防、及びテロ対策などの正当化事由と、新たな監視手段の導入に伴う問題について新たな視点から問題点を明らかにした。また、監視社会化の傾向が顕著になるにつれ、問題の本質は新たな技術手段の開発や導入にあるのではなく、既存の技術も含めて、それらの技術が日常的に用いられることによって個人の抵抗感や意識が低下することが最大の問題であると指摘した。
